Welcome to Viupik. By accessing and using our platform, you accept these Terms and Conditions. Please read them carefully before using our services.

1. Description of Service

Viupik is a SaaS (Software as a Service) platform designed for real estate professionals. We offer AI-powered image generation and enhancement tools (virtual home staging, sky enhancement, architectural render generation), AI-powered real estate presentations, lead management, and team collaboration tools.

2. Eligibility and Registration (Professional / B2B Use)

Viupik is a platform aimed exclusively at professionals, self-employed workers, and companies in the real estate sector and related industries. By registering, you expressly declare that (i) you contract the service in the exercise of your professional or business activity, and NOT as a consumer under Spanish Royal Legislative Decree 1/2007; (ii) you have sufficient legal capacity to contract and, where applicable, to bind the company on whose behalf you act; and (iii) you are at least 18 years old. You agree to provide truthful, current, and complete information, and you are responsible for maintaining the confidentiality of your credentials and for all activities conducted from your account.

3. Account Responsibilities

You are responsible for all activity conducted from your account. You must immediately notify Viupik of any unauthorized use or security breach. Viupik shall not be liable for losses arising from unauthorized use of your account.

4. Ownership of AI-Generated Content

Content generated through our artificial intelligence tools (renders, home staging images, sky and pool enhancements, presentation texts) is owned by the user who generates it, to the extent permitted by applicable law.

By using our content generation services, you grant Viupik a non-exclusive, worldwide, royalty-free license to store, process, and display such content for the purpose of providing you the service (for example, storing your renders in the project gallery or displaying them in published presentations).

You acknowledge that AI-generated content is produced using third-party services (including OpenAI and other providers) and that such content is subject to these providers' usage policies. Viupik does not guarantee that AI-generated content is original, unique, or free from similarities with other existing content.

Generated images are illustrative and non-contractual. They should not be used as faithful or exact representations of real estate properties in legal or contractual documents.

5. Public Presentations

Real estate presentations created on Viupik can be published at publicly accessible URLs. The design, structure, and templates of presentations are Viupik's intellectual property. The specific content of each property (images, texts, data) belongs to the user who created them. By publishing a presentation, you authorize Viupik to make that content publicly accessible through the generated URL.

6. Credit System and Payments

Viupik operates on a credit system associated with subscription plans. Subscription credits are renewed each billing period and unused credits do not carry over. Separately purchased credits do not expire.

Payments are processed through Stripe. By subscribing, you authorize recurring charges according to the selected plan. You may cancel your subscription at any time, effective at the end of the current billing period.

Viupik reserves the right to modify pricing and credit structure with 30 days' prior notice.

7. User-Uploaded Content

You are solely responsible for the content you upload to Viupik (photographs, documents, property information). You warrant that you have the necessary rights to such content and that it does not infringe third-party rights. You must not upload illegal, defamatory content, or content that violates third-party intellectual property rights.

8. Viupik's Intellectual Property

The Viupik brand, logo, platform design, source code, presentation templates, and all visual and functional elements of the platform are the exclusive property of Viupik or its licensors. Unauthorized reproduction, distribution, or modification of these elements is prohibited.

9. Limitation of Liability

Viupik provides its services "as is" and "as available." We do not guarantee that services will be uninterrupted, error-free, or that AI tool results will meet your specific expectations.

To the maximum extent permitted by law, Viupik shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities.

Viupik's total liability to you shall not exceed the amount paid by you during the 12 months preceding the event giving rise to the claim.

10. Termination

You may close your account at any time. Viupik reserves the right to suspend or cancel your account if you breach these terms, use the platform abusively, or engage in fraudulent activities. Upon termination, you will lose access to your account and stored content after a reasonable grace period.

11. Governing Law and Jurisdiction

These terms are governed by the laws of Spain. Given that the platform is marketed exclusively on a B2B basis (professionals and businesses), the parties expressly waive any other jurisdiction that might apply and submit exclusively to the courts of Madrid, Spain, for the resolution of any dispute arising from these Terms.

12. Modifications

Viupik reserves the right to modify these terms at any time. We will notify you of significant changes via email or platform notice at least 30 days in advance. Continued use of the platform after notification constitutes acceptance of the new terms.
